Tehran, SAEDNEWS, Feb. 25: As stated in the UNHCR Resolution 44/5, the issue of the Ukrainian plane is not within the framework of the mission and jurisdiction of the special rapporteur on extrajudicial and arbitrary killings, Foreign Ministry Spokesman Saeed Khatibzadeh said on Wednesday.
“In international law, there are clear and precise legal and technical frameworks for dealing with such issues, and the scope of the rapporteur's practice has nothing to do with these frameworks and regulations, but the immature and unreasonable interference of the reporter may have a non-constructive effect on legal processes either,” he added.
“Numerous cases and arguments have been raised by her which show that the information provided to her used as the basis of this text was distorted information, mixed with numerous, biased and irrelevant mistakes,” Khatibzadeh said.
He noted that Callamard should have waited for the technical report of the incident and indictment of the suspects, adding, “The technical report of the accident was prepared in accordance with the international standards on December 29, 2020, and sent to the relevant countries. So far, 3 countries have sent their technical comments on this report to the relevant authority, and most of them have confirmed the technical report.”
Khatibzadeh said that the final report will be publically released by the end of the current Iranian year (March 20), adding that indictment for the suspects will also be issued soon.
He noted that perhaps one reason for Callamard’s unwarranted haste is her resignation from the position of special rapporteur and she wanted her successor to face a fait accompli, adding that maybe she has been promised new job opportunities in certain non-governmental organizations for releasing a politicized text.
Khatibzadeh, meantime, said that regardless of Callamard’s intentions and incompetence to opine on the issue, Iran has, based on the principle of good will, prepared detailed answers to the questions and ambiguities which will be presented soon.
Callamard had written a letter to the Iranian Government on the crash which was published on Tuesday.
Her letter claimed that the Iranian authorities violated the right to life of the passengers and crew onboard the plane.
Iranian Ambassador to Kiev Manouchehr Moradi said in January that the case of the Ukrainian Plane Flight PS752 is being pursued seriously at Tehran’s military court, stressing that the rights of the victims and the bereaved families will be materialized fairly according to international rules.
Moradi said that a military court in Tehran is engaged in the follow-up of the case of the Ukrainian crashed plane, and reminded that the fair settlement of the PS752 case and the provision of the rights of the victims and their families will be achieved in compliance with international rules.
“The Islamic Republic of Iran has sent the draft of the final technical report to Ukraine and other relevant countries before the designated and renewable period in the Chicago Convention, and it is waiting for their opinion,” he wrote on his Twitter account in Ukrainian language.
“Ukraine's demands have also been met in the second round of talks in Tehran, although they were not within the framework of Iran's international obligations,” Moradi added.
He further wrote that all the convicts will be brought to justice.
A Ukrainian Boeing 737 passenger plane was accidentally shot down by an Iranian rocket near Tehran on January 8, 2020.
It happened after the US terrorist attack against motorcade of Lieutenant General Qassem Soleimani, late anti-terror Commander of the Islamic Revolution Guards Corps (IRGC) Qods forces and his companions near Baghdad airport on January 3, 2020.
Iran reciprocated the US terrorist operation by hitting the US Ain al-Assad airbase in Iraq.
Commander of the IRGC Aerospace Force Brigadier General Amir Ali Hajizadeh admitted that human error the incident.
In relevant remarks last month, Iran’s Judiciary Chief Ayatollah Seyed Ebrahim Rayeesi said there is no redline for his country in the follow-up and investigation into the Ukrainian Plane Flight PS752.
“The Islamic Republic of Iran considers no redline in the probe into the case of the crashed Ukrainian plane,” Rayeesi said.
“The report of the Judicial Organization of the Armed Forces has been completely announced to the families of victims of the incident,” he noted, adding, “This can remove any doubt in this respect.” (Source: Fars News).
